Ban/Gag reason Rasicm + insulting other players

Desired outcome Lift my punishment

Statement of grounds
Hi all,

I am creating a second ungag/unmute request because I feel my first request was closed before I had a proper chance to defend myself.

Original thread: https://forum.elite-hunterz.com/threads/cs-s-all-cs-go-zm-protest-a-punishment-sexobeastpw.15594/

I am also making this second request because RXT appeared to go offline before my last comment in the previous thread, so I am not sure if my final points were properly seen or considered before the case was closed.

I would like to ask for another admin than RXT, preferably someone who was not involved in the original decision, to review this case.

My main concern is that the gag/mute seems to have been based on assumptions about what I meant, rather than what was actually written. I received both an insult and racism gag/mute without any admin warning beforehand. Even if the use of asterisks could be seen as annoying or unclear, I think a gag without warning was already harsh, and the mute part does not really make sense to me.

Regarding the “insulting” reason, RXT also said in the other thread that this could have been handled with a warning. However, it was still included as one of the punishment reasons.

Regarding the racism part, I still disagree with the conclusion. I was fooling around with asterisks while trying not to directly insult anyone or break the rules. I did not write any racist word, and the character count in the logged message does not match the racist word people are assuming I meant. I also stopped using the asterisks once Salem told me that people were taking it negatively.

From my point of view, it felt like the situation escalated because Shikaka kept pushing in chat for me to be punished. After I had already stopped, RXT said something like “dw it’s being handled,” and I was then gagged + muted without warning. That is why I would appreciate an independent review of the situation.

I understand now that using asterisks like that can be interpreted badly, and I will not do it again. But I still feel the punishment reason and severity are unfair for what was actually written.

Thanks.

Again a SPA/HA had closed the previous case not me. So they had already reviewed and agreed with the decision.

However i can assure you that the gag was my decision and mine only.

Its good to see the gag has already had a postive impact on your behaviour but the length will remain the same.

Any future gags will be longer.

Reactions: Dunja =)
It seems that Dunja finds it funny that I am genuinely asking what I did wrong, so I can understand it and prevent it in the future.

From my point of view, I am being punished for “racism” without any racist word being written. The decision seems to be based on what you assumed I meant, not on what was actually said.

That is why I think this sets a bad precedent. If unclear or censored messages can be punished based on the worst possible interpretation, then the same could happen with abbreviations, jokes, or messages that have multiple meanings.

To me, this just feels unfair. If an admin already dislikes someone, they can assume the worst possible intent behind anything unclear and use that as a reason to gag them without warning.

If that is the standard EH allows, then I guess there is not much I can do about it.
To be clear, I do think I should have been gagged if I had continued after a warning, but punishing me without any warning based on assumed intent rather than clear rule-breaking still seems unfair to me.

Hi sexobeast,

As the SPA responsible for overseeing server moderation and admin decisions, I have reviewed both of your appeals. I will now provide the final assessment on this matter.

Our server rules and enforcement standards have been clearly defined and consistently applied for over a decade. The claim that this decision is based on arbitrary interpretation or personal dislike is incorrect. Our guidelines specifically cover both direct violations and attempts to bypass filters or rules through obfuscation.

To address your main points directly:
  • The Use of Asterisks and Intent: Writing highly suggestive messages combined with specific remaining letters to form a recognizable pattern is a well-known method used to bypass chat filters and rules. The context, the reactions of the players present, and the specific letters left in the log make the provocative and racist nature of the message clear.
  • Zero-tolerance-politic: While admins generally issue warnings for minor infractions or standard spam, severe violations such as racism do not require a prior warning. The responsibility lies with the player to follow the rules at all times.
  • The Length of the Punishment is absolutely correct: Elite Hunterz operates on a progressive penalty system based on a player's administrative history. The three-week duration of this gag is not a random length - it is the direct and logical next step resulting from your extensive list of prior gags (your last one was 2 weeks for insulting players.
We do appreciate that you have stated you will refrain from using asterisks in this manner in the future. However, a reduction of the punishment is denied by the admin in charge, who has my full support regarding his decision. The three-week gag and mute will remain fully in place to ensure our community standards are respected and to give you enough time to consider your chat behavior in the future.

Ps. Any further threads regarding this specific punishment will be closed.

I still disagree with the conclusion, but I appreciate the extra review effort.

The word being implied does not match the character count of what I wrote, so calling it “clear” intent is still based on assumption. Leaving an n and a g in a censored word does not automatically make it racist; plenty of normal words could look bad if partially censored, for example “nagging”.

I understand the decision is already made, so there is not much more to say. Thanks for the review.
